A Study on the Environmental Legislation in the Perspective of Eco-civilization

Eco-civilization is an inevitable product of the historical development of human society and productive force when they reach certain stage, which refers to the overall cultural achievement that realizes the sustainable development of and harmony among nature, human, and social environment. As an advanced form of human civilization, eco-civilization is an innovative and particular condition of the human-nature relation; it is the crystallization of thoughts and wisdom when the human civilization undergoes the high development of science and technology and the promotion of information age. It includes, in a narrower sense, the more civilized and less barbarous way in treatment with Nature; furthermore, through the cultural values, ways of production, styles of living, and social structure, it also embodies in a broader sense a new perspective on the human-nature relation.This dissertation chooses the environmental legislation as the entrance for probing the eco-civilization, because legislation is the first step towards the realization of law ruling for the harmony between human and nature; eco-civilized legislation has fundamental significance to an eco-civilized society. At the same time, the ideology of eco-civilization can play a role of orientation, which cannot be neglected; the legislators'knowledge and mastery of the eco-civilization theory, and their balance-striking of the relations among human beings and between human and nature can greatly influence the quality of legislation.The first chapter, through its back tracing of the relation between civilization and legislation, reviews the neglect of the human-nature relation in the traditional law making patterns, and introduces the relation between eco-civilization and environmental legislation.
