Anti-monopoly Regulation of Network Economy

Network economy is a new problem that anti-monopoly law has to face in the 21st century, because it has brought in a new economy form, and some economics issues and political factors, and enactment of China anti-monopoly law have to deal with network economy. The anti-monopoly issues in network economy have been paid more and more attentions, however the theoretical framework of anti-monopoly analysis of network economy has not been established. Basing above analyses, the author studies the anti-monopoly issues in network economy comprehensively, and tries to establish a common framework to analyze them.In order to confirm the research border of the dissertation, the meanings of network economy are proposed first. The author uses network economy to denote the industries with network economic features such as network economic effects, etc. Then the common economic features of network are reviewed, and some disputed concepts are redefined. The industrial organization features of network ecomony, including market structure, market behaviors and market performance,are the economical base for anti-monopoly analysis of network economy. After examining the related papers, the author investigates industrial organization features of network economy from both theoretical and positive views. It is found that the industrial organization features of network economy shows an uncertainty of enterprises'behaviors, which may be efficient in some conditions and inefficient elsewhere, which creates difficulties for anti-monopoly's intervening. The author shows how to overcome the difficulties by reveiwing the related views.The above analyses provide a common analytical framework for anti-monopoly analysis of network economy, and the author then studies common anti-monopoly theory in network economy. The results show that anti-monopoly law should taken economical efficiency as its core value to meet with network economy, wherein economical efficiency means weighing static efficiency, dynamic efficiency and transaction cost. Futhermore, rule of reason should be main principle of anti-monopoly law in network economy. Then the author gives the substantial differences between network economy and natural monopoly industry, which means network economy can not be considered as a natural monopoly industry which is regulated mainly by
